Terms of Use

1 Parties & Agreement

These Terms of Use constitute a legally binding agreement between you ("User", "you", "your") and JozaForge ("Developer", "we", "us", "our"), the developer and publisher of Retakr – Digital Life Control (the "App").

The App is distributed exclusively through the Google Play Store. These Terms are separate from and supplemental to Google Play's terms of service. In the event of a conflict between these Terms and Google Play's terms regarding payment or distribution, Google Play's terms shall govern for those matters.

By installing the App, you represent that:

• You are at least 13 years of age (or the minimum digital age of consent in your country);
• If you are between 13 and the age of majority in your jurisdiction, a parent or guardian has consented to these Terms;
• You have the legal capacity to enter into a binding agreement;
• Your use of the App complies with all applicable local, national, and international laws.

2 Description of the App

Retakr is a digital wellbeing and parental-control application for Android devices that allows users to:

• Block apps entirely – prevent specific applications from being opened.
• Set daily app time limits – automatically block an app after a user-defined number of minutes per day.
• Schedule app blocks – block apps during specific time windows (e.g., during work or study hours).
• Block specific websites (URLs) – prevent access to designated website addresses.
• Keyword-based web protection – block websites containing keywords associated with adult content, gambling, violence, drugs, or custom user-defined categories.
• Browser management – whitelist specific browsers and block all others.
• Protection PIN – require an 8-digit PIN to modify blocking settings, making it harder to bypass restrictions in moments of impulse (available on all plans; Pro unlocks additional protected actions).
• Uninstall Protection – use Device Administrator privileges to prevent easy uninstallation of the App (available on all plans).
• Strict Mode – block access to critical Android settings screens to prevent disabling protection (Pro only).

The App operates entirely on-device and does not require an internet connection for its core blocking functionality. It does not create user accounts or store data on remote servers.

3 License Grant

Subject to your compliance with these Terms and payment of any applicable fees, JozaForge grants you a limited, non-exclusive, non-transferable, revocable license to install and use Retakr on Android devices that you own or control, solely for your personal, non-commercial use.

This license does not permit you to:

• Copy, modify, merge, publish, distribute, sublicense, or sell copies of the App;
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App;
• Remove, obscure, or alter any proprietary notices, labels, or marks;
• Use the App for any commercial purpose or for the benefit of any third party;
• Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App;
• Circumvent or attempt to circumvent any security or access-control features of the App.

JozaForge reserves all rights not expressly granted in these Terms. The App is licensed to you, not sold.

4 Purchase Plans & Features

Retakr offers three tiers of service:

All prices are displayed in your local currency on the Google Play Store listing and are inclusive of applicable taxes where required by law. Prices may vary by region and are subject to change. We will provide reasonable advance notice of price changes via the Google Play listing or an in-app notice.

5 Billing & One-Time Purchases

All purchases are processed through Google Play Billing. Your relationship with Google regarding payment is governed by Google Play's terms of service and payment policies.

One-Time Purchases

Standard and Pro plans are offered as one-time, non-recurring purchases. You pay once and receive access to the features of that plan for as long as JozaForge continues to distribute the App, including future updates and major version upgrades at no additional charge, provided you remain in compliance with these Terms. JozaForge does not offer subscriptions and does not intend to introduce them.

Downgrading to Free

If you downgrade to Free, features requiring Standard or Pro will be locked. All app data — including your blocking rules and settings — is stored exclusively on your device. Uninstalling the App permanently deletes this data. JozaForge has no servers and no ability to back up or restore your configuration.

6 Refunds

All purchases are made through the Google Play Store and are subject to Google Play's refund policy. Generally:

• Google allows users to request a refund within a short window after purchase through the Google Play Store.
• JozaForge does not independently process refunds; all refund requests must be submitted directly to Google Play.

EU / EEA / UK Statutory Right of Withdrawal

If you are a consumer resident in the European Union, European Economic Area, or United Kingdom, you have a statutory right to withdraw from a purchase within 14 days of the transaction date ("cooling-off period"), unless you have explicitly waived this right by requesting immediate access to the digital content (which begins upon purchase). When you tap "Buy" and the Pro or Standard features are immediately unlocked, you may be deemed to have consented to the immediate performance of the contract and acknowledged that the right of withdrawal is thereby lost. Please check your local consumer rights laws or contact us if you believe you qualify for a withdrawal.

Technical Issues

If a technical issue prevents you from accessing purchased features, please contact us at supportjozaforge@gmail.com before requesting a refund. We will make reasonable efforts to resolve technical issues promptly.

7 Restoring Purchases

If you reinstall the App or switch to a new Android device, you can restore your previous purchase by tapping the "Restore Purchases" button on the Plans screen. This contacts Google Play to verify your existing entitlements.

Restoring purchases requires an internet connection and that you are signed in to the same Google Play account used for the original purchase. JozaForge is not responsible for inability to restore purchases caused by changes to your Google account, Google Play policies, or device limitations.

8 Acceptable Use Policy

Retakr is intended to help individuals and families manage their own digital habits and protect themselves from unwanted content. You agree to use the App only for lawful purposes and in a manner consistent with these Terms.

Permitted Uses

• Personal use to limit your own app and internet usage.
• Parental use on devices owned by you and used by your minor children, with appropriate parental authority.

Prohibited Uses

9 Android Permissions & Your Responsibilities

Retakr requires specific Android permissions to function (as detailed in our Privacy Policy). By granting these permissions, you acknowledge:

• Accessibility Service: This permission enables Retakr to read URL content in browsers. You are responsible for ensuring all users of the device have been informed that this service is active, as required by your local laws.
• Usage Access: This permission enables Retakr to query app usage statistics. You are responsible for compliance with any applicable laws regarding monitoring app usage on shared devices.
• Device Administrator (Admin Protection): Granting Device Administrator privileges is voluntary. You may remove Device Admin status at any time through Android Settings → Security → Device Admin Apps, which will disable Admin Protection. We are not responsible for any consequences resulting from your use of Admin Protection, including difficulty accessing device settings.

You are solely responsible for configuring the App appropriately and for any consequences of the blocking rules you create.

10 Intellectual Property

The App, including its source code, design, graphics, user interface, trademarks, trade names, logos, and all related materials, is owned by JozaForge and protected by copyright, trademark, and other applicable intellectual property laws worldwide. Nothing in these Terms transfers any intellectual property rights to you.

The name "Retakr", the logo, and the tagline "Digital Life Control" are trademarks of JozaForge. You may not use these marks without our prior written consent.

We acknowledge and respect the intellectual property rights of third parties. The App uses open-source libraries under their respective licenses, which are available upon request.

JozaForge reserves the right to release portions of the App's source code under an open-source license in the future, at its sole discretion.

11 Disclaimers of Warranties

To the fullest extent permitted by applicable law, JozaForge expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranty that the App will be uninterrupted, error-free, or free of viruses or other harmful components;
• Any warranty regarding the accuracy, completeness, or reliability of any content within the App;
• Any warranty that the App will successfully block all unwanted content at all times — content filtering based on keywords and URL matching is inherently imperfect and certain content may not be blocked.

You acknowledge and agree that:

• The effectiveness of blocking features depends on Android system versions, manufacturer customizations, and the specific apps and browsers used, which may change without notice;
• Android OS updates, changes to Google Play policies, or changes to browser apps may affect the App's functionality;
• The App cannot guarantee 100% effectiveness in blocking all harmful content;
• The App's blocking features require certain Android permissions to be granted; if permissions are revoked, the relevant features will not function.

Nothing in these Terms affects any statutory rights you may have as a consumer under the law of your country, which cannot be excluded or limited by contract.

12 Limitation of Liability

To the maximum extent permitted by applicable law, JozaForge, its officers, directors, employees, agents, licensors, and suppliers shall not be liable for:

• Any indirect, incidental, special, exemplary, consequential, or punitive damages;
• Loss of profits, revenue, data, goodwill, or business opportunities;
• Damages resulting from your inability to use the App or from system failures;
• Content accessed by users despite the App's filtering efforts;
• Damages resulting from your reliance on information provided by the App;
• Any other damages arising out of or in connection with these Terms or your use of (or inability to use) the App.

In no event shall JozaForge's total liability to you for all claims arising out of or related to these Terms or the App exceed the greater of: (a) the total amount you paid JozaForge in the twelve (12) months preceding the claim, or (b) USD $10.00.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law, and the above limitations may not apply to you.

13 Indemnification

You agree to indemnify, defend, and hold harmless JozaForge and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms;
• Your use of the App in violation of applicable laws;
• Your installation of the App on another person's device without proper consent;
• Your misuse of the App's administrative or monitoring features.

14 Termination

These Terms remain in effect until terminated by either party.

You may terminate this agreement at any time by uninstalling the App. Standard and Pro are one-time purchases with no recurring charges to cancel.

JozaForge may terminate or suspend your access to the App (including by disabling purchase entitlements) if:

• You violate any provision of these Terms;
• You engage in fraudulent, abusive, or illegal conduct in connection with the App;
• Required by law or by Google Play policies.

Upon termination, all licenses granted to you under these Terms cease immediately. Sections 10, 11, 12, 13, 16, and 17 of these Terms shall survive termination.

15 App Updates & Changes

JozaForge may from time to time release updates to the App via the Google Play Store. Updates may add, modify, or remove features. By enabling automatic updates or manually installing an update, you accept any changes to the App's functionality.

We reserve the right to discontinue the App or any feature at any time. In the event the App is discontinued, we will give reasonable advance notice where practicable and will make reasonable efforts to ensure that paid users are not left without recourse (e.g., through refunds where legally required).

We also reserve the right to modify these Terms at any time. Material changes will be communicated via the Google Play listing or an in-app notice. Your continued use of the App after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the App.

16 Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to JozaForge's jurisdiction of operation, without regard to its conflict of law provisions.

This choice of governing law does not deprive consumers of the protection afforded by mandatory provisions of the law of their country of habitual residence. If you are a consumer in the EU/EEA/UK, you benefit from any mandatory provisions of the law of your country of residence, and the applicable governing law does not exclude such protections.

17 Dispute Resolution

Informal Resolution

Before initiating any formal proceeding, you agree to contact us at supportjozaforge@gmail.com to attempt to resolve the dispute informally. We will try to respond within 30 days of receiving your notice.

Binding Arbitration (where applicable)

If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the App, except where prohibited by local law, shall be resolved by binding arbitration administered in accordance with widely recognized arbitration rules. The arbitration shall be conducted in the language of these Terms (English). The arbitrator's award shall be final and binding, subject to review only on the grounds permitted by applicable arbitration law.

Class Action Waiver

To the extent permitted by applicable law, you waive any right to participate in a class-action lawsuit or class-wide arbitration against JozaForge. This waiver does not apply where prohibited by law (for example, in EU consumer proceedings).

Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

18 EU & UK Consumer Rights

If you are a consumer resident in the EU, EEA, or UK, the following additional provisions apply and take precedence over conflicting provisions in these Terms to the extent required by law:

• Digital Content Conformity: We warrant that the App will conform to its description and be fit for purpose as required under applicable EU/UK digital content laws (e.g., EU Directive 2019/770, UK Consumer Rights Act 2015). If it does not conform, you have the right to repair, replacement, or a price reduction or refund.
• Right of Withdrawal: As noted in Section 6, you may have a 14-day right of withdrawal from the purchase of digital content unless you have consented to immediate performance.
• Online Dispute Resolution: The European Commission provides an online dispute resolution (ODR) platform at ec.europa.eu/consumers/odr. Our contact for ODR purposes is supportjozaforge@gmail.com.
• No limitation of mandatory rights: Nothing in these Terms limits or excludes any rights you have as a consumer under EU or UK law that cannot be waived.

19 Australian Consumer Law

If you are an Australian consumer, the Australian Consumer Law (ACL) provides guarantees that cannot be excluded. To the extent permitted by law, our liability for failure to comply with a consumer guarantee is limited to:

• For services: supplying the services again, or paying the cost of having the services supplied again.
• For goods (where applicable): replacing or repairing the goods, or paying for the replacement or repair.

Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the ACL.

20 Brazilian Consumer Law (CDC)

If you are a consumer resident in Brazil, the Brazilian Consumer Protection Code (Código de Defesa do Consumidor — Law No. 8,078/1990, "CDC") provides rights that cannot be excluded or waived by contract. To the extent that any provision of these Terms conflicts with a mandatory right under the CDC, the CDC shall prevail.

• Product Liability: JozaForge is responsible for defects in the App that render it unfit for the purpose described or that diminish its value. If such a defect is identified, you have the right to request repair, replacement, a proportional price reduction, or a full refund, as applicable under Arts. 18–20 CDC.
• Liability Cap: The USD $10 liability cap in Section 12 does not apply to Brazilian consumers. JozaForge's liability to Brazilian consumers is governed by the CDC and is not contractually limited below what the law permits.
• Right of Withdrawal (Arrependimento): Purchases made outside a physical establishment (including Google Play purchases) are subject to a 7-day right of withdrawal from the date of purchase under Art. 49 CDC, without penalty and without stating a reason. To exercise this right, contact us at supportjozaforge@gmail.com within 7 days of purchase.
• Abusive Clauses: Any clause in these Terms that places you at an excessive disadvantage or is incompatible with good faith, as defined by Art. 51 CDC, is null and void to that extent.
• Dispute Resolution: Brazilian consumers may bring disputes before the Procon consumer protection agency of their state, or through the federal platform consumidor.gov.br.

21 Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any additional terms incorporated by reference herein, constitute the entire agreement between you and JozaForge concerning the App and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, relating to the subject matter herein.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
